
Terms and Conditions
So we are both happy, please take the time to read the terms and conditions below before filling in any booking request form we send to you. If you have any questions regarding the terms & conditions, or anything else to do with our villa, please do not hesitate to contact us.
1. Booking
The signing of the booking form confirms the acceptance of the terms and
conditions set out below and shall be binding on all the persons occupying the
property, whether or not such persons have signed the booking form. The Owners
will confirm the booking as soon as possible after receipt of the signed booking
form and reservation deposit of £300/$400. The full rental amount must be paid
at least 10 weeks prior to arrival. The reservation deposit will be held as a
security deposit until the property is vacated.
2. Cancellations In the event of cancellation of this rental agreement the
following fees will be applied:
Cancellation prior to full payment; deposit is non-returnable
Cancellations
2-6 weeks before arrival; 75% of rental charge
is non-refundable
Less than 2 weeks before arrival; 100% of rental
charge is non-refundable
Cancellations must be received in writing.
We
strongly recommend full comprehensive travel insurance.
3. Security Deposit
Upon signing the rental agreement the signatory agrees to pay for any damage of
any kind to the property from security deposit.
The deposit is fully
refundable after your departure from the property, providing there are no
damages such as (but not exclusively)
a. No damage is done to the villa or
its contents, beyond normal wear and tear
b. No charges are incurred due to
contraband, pets or collection of rents or services rendered during the stay
c. All debris, rubbish and discards are placed securely in liners (bags) and
placed in the bins and all soiled dishes are placed in the dishwasher and
cleaned.
d. Any charges accrued during the stay are to be paid prior to
departure.
e. Linens are not lost or damaged
f. The renter is not evicted
by the owner (or representative of the owner), the local law enforcement, or
security company employed by Windsor Palms community
In
the event of any costs in excess of the security deposit including but not
exclusively; damage of any kind to the property, excessive cleaning costs,
excessive electricity costs (often due to leaving blinds on the windows pulled
up, windows open or external doors open with air conditioning on) etc, the
signatory will be held fully responsible/liable and will be invoiced once home
for the extra costs.
4. Liability
The Owners and Management Company of the property accept no responsibility
whatsoever for the death, personal injury, accidents, loss or damage to persons
or personal belongings however caused. The use of accommodation and amenities is
entirely at the users own risk. Children must be supervised at all times by a
responsible adult. GLASS is not permitted in the pool area. The owners and
management company cannot accept any liability for the late arrival at or early
departure from the accommodation for any reason out of their control.
5. Responsibilities
The renters will be responsible for the property and are expected to take
all reasonable care of it, including the locking of all doors and windows when
the property is left unoccupied. At the end of the rental period the property
and all its contents must be left clean and tidy. No item may be removed. The
contents will be checked against the villa inventory and the cost of any missing
item will be recovered from the security deposit. All necessary legal steps will
be taken by the owners or thr management companies US office to recover
excessive costs. Any unfortunate occurrence must be reported to the management
company immediately such that it may be remedied;
e.g. the staining of a carpet or sofa can be minimal if dealt with quickly and
in turn help minimize any damage costs to the renter.
6. Party Size
All individuals occupying the property including babies and small children
must be listed on the booking form. This is Florida
state law and must be adhered to. The accommodation cannot be shared, assigned
or sub let and only persons shown on the booking form are permitted to stay at
the property. The owners reserve the right to refuse admittance or terminate the
rental agreement if this condition is not met. Failure to comply
will render
the booking void and no compensation will be paid. The property is fully
licensed for short-term rental in Florida.
NO PETS
are permitted in the property at any time, whatsoever.
7.
Arrivals and Departure time
The house will be available for occupancy from 4.00pm on day of arrival and must
be vacated by 10.00am (prompt) on day of departure. Failure to leave at the
agreed time, the renter will incure a late departure fee of another full days
costs, which will be deducted from the security deposit. Our management Company
have the right to remove overstay renters by any means they see appropriate, and
shall not be responsible for any costs you may incur, nor shall we pay any
compensation, nor make any subsequent refund.
8. Smoking
For the safety and comfort of all of our guests smoking is not permitted
anywhere within the property or outside the front of the property. The only
permited smoking area, is at the rear of the property on the pool deck, all
tobacco stubs and waste should be placed in bags in the outside trash cans only,
and the use of ashtrays should be adhered to at all times. Any smoking waste
found will incure an excess cleaning cost of $130
9. Code of Conduct
Windsor Palms is a
residential community, as well as being a short term rental community. Nothing
should interfere with the quiet enjoyment of other holidaymakers and residents.
Please do not swim, play loud music or do anything else which is likely to
inconvenience your neighbours after 10.30pm or before 7.30am. In the event that
anyone in your party behaves in such a way which our management company,
local law enforcement, or security company employed by
Windsor Palms community believes is likely to cause distress, annoyance
or danger to anyone else, or damage any property within Windsor Palms, the
owners or the management company reserve the right to terminate the rental
agreement with immediate effect and shall not be responsible for any costs you
may incur, nor shall we pay any compensation, nor make any subsequent refund.
10. Insurance
It is a condition of this booking that all members of the party have
comprehensive travel insurance, including adequate protection against delays and
cancellation, loss of luggage and personal belongings and has adequate medical
insurance for the USA.
11. Unavailability
As with any other holiday, there may be circumstances in which the property may
not be available for your booking. Examples of these circumstances include (but
not limited to) destruction of or severe damage to the property. The owners will
do their best to make alternative arrangements for you where possible. If they
cannot, then they will only refund up to the total monies recieved for this
booking. This will be the full extent of the owners’ liability to you in such
circumstances, and they shall not be responsible for any other costs connected
with any such cancellation, nor are we responsible to pay any compensation, nor
make any subsequent refund however arising.
12. Law
This contract is subject to and shall be construed in accordance with United
Kingdom, United States and Florida state laws.
13. Owners Access
The owners or their management company shall be permmited access at any
reasonable time during your stay. If damage to the property is reported or
suspected the management company will access the villa for full inspection
without the permmission or presence of the renter. The owners and management
company shall not be responsible for any costs you may incur, nor shall we pay
any compensation, nor make any subsequent refund.
14. Passports/Visas
It is the responsibility of any individual traveling to the United States to
ensure that they make the appropriate arrangements to
secure their entry.
Passport/visa requirements change from time to time and are not within the scope
of the booking contract.
15. Problems/complaints
In either event they are to be reported in the first place to the management
company and if not dealt with to the renters’ satisfaction, then to the owner in
writting.
